File an Assumed Business Name

You must determine if the name you wish to use is available. To determine if the name you wish to use is available i.e. not being used by another business, you may conduct a search using the County Clerk’s website, or you may use a public work station located in Suite 120, of the Paul Elizondo Tower. You must submit the appropriate notarized form to the County Clerk’s office. You can submit the form in person or through the mail.

Assumed Name Certificates must be either notarized or acknowledged before they can be filed with the County Clerk’s office.  You may have the assumed name certificate notarized by a notary public who will normally charge a fee of at least $5, or you may choose to have the certificate acknowledged by a deputy in the County Clerk’s office for a fee of $1. 

You may download and print the forms above and bring them to the County Clerk's Office. Or you may enter the information on-line. When you are done, the forms will be submitted electronically and will be waiting for you when you visit the County Clerk's Office to complete the process. Electronic applications will be available for 5 days after you enter them.

To register an Assumed Business Name with the County Clerk, you must:

1Confirm the Name is Available

To determine if the name you wish to use is available i.e. not being used by another business, you may conduct a search using the County Clerk’s website, or you may use a public work station located in Suite 120, of the Paul Elizondo Tower.

2Submit Notarized DBA Form

You must submit the appropriate notarized form to the County Clerk’s office. You can submit the form in person or through the mail.

3Pay $14 for 1 Owner + $50¢ Per Owner

The filing fee is $14.00 for one owner and $0.50 for each additional owner. Copies are extra.

There are two buildings connected to the courthouse. Building 1 is the courthouse. Building 2 is the Justice Center. Building 3 is the Paul Elizondo Tower (PET).

There is a tunnel located in the basement. The tunnel connects the courthouse to the Justice Center (see the dotted lines below). To access the tunnel, go through the sliding glass doors located next to the elevators in the basement of the courthouse. To enter the PET from the Justice center, go across the courtyard.

What is the fee to file an Assumed Business Name?

  • The fee for a plain copy is $2.00.
  • The fee for a certified copy is $7.00.
  • Both cash and check payments are accepted (temporary checks are not accepted)

Does an Assumed Name ever expire?

The assumed name certificate is valid for ten years from the date of registration.

Who can execute the assumed name certificate?

Must be executed by an officer, general partner, member, manager or attorney-in-fact. Executed by an attorney-in-fact must include a statement that the attorney has been authorized in writing by the attorneys principal to execute the certificate. (Texas Business & Comm. Code 71.104)

Can I view and print the Assumed Business Name forms on the County Clerk’s website?

Yes, you can do it through our online application.

Can a copy of the original notarized Assumed Business Name document be submitted to the County Clerk’s office?

The original Assumed Business Name certificate must be submitted to the County Clerk’s Office; a copy will not be accepted.

If I have partners, does everybody have to file?

Yes, everyone conducting business as a partner must file an assumed name for each business name. Each partner must sign form in front of notary before the assumed name is filed with the county clerk.

Can I amend an assumed name certificate to change incorrect information?

No, however, the law requires an assumed name registrant to file a new assumed name certificate when the information contained in the certificate is or becomes materially misleading. (Texas Business & Comm. Code 71.152)

What if I am no longer using an assumed name for my business?

If you are no longer conducting business under that assumed name, you may file a notice of abandonment.

Can I file more than one Assumed Business Name?

Yes, applicants may conduct business under multiple assumed names, but each name must be filed separately.

Is an Assumed Business Name a license?

No, you may contact the City of San Antonio to determine if a business license is required.
